These Terms of Use govern your use of our service. As used herein, the terms “SKULI", "our service,” "the App" or “the service” refer to the service provided by SKULI for discovering and accessing its Content, including all features, recommendations, user interfaces, as well as all content and software associated with our service. “You” refers to the user who has created a SKULI account and is being charged subscription fees through the chosen Payment Method if a plan has been subscribed.
1. SKULI Service
1.1. Description
SKULI provides a digital educational platform designed for children, enabling interactive learning through personalized quizzes, audio recaps, and gamified rewards. Parents and guardians may create profiles for children and supervise their learning experience.
1.2. Availability & Requirements
To access the SKULI app, you must have an internet connection, a compatible device, and a registered account. Some features require a valid subscription and may be restricted based on the user’s subscription status.
1.3. Educational Use Only
SKULI is intended for personal, non-commercial educational use only. All content, quizzes, audio, and features must not be redistributed, shared, or used outside the permitted scope of the app.
1.4. Parental Responsibility
Parents or legal guardians are solely responsible for supervising their child’s use of the SKULI app. They agree to:

Ensure their child does not engage in misuse or abuse of the service

Protect login credentials and parental access codes
1.5. Updates & Modifications
We reserve the right to modify or discontinue parts of the service at any time, without notice, for maintenance, improvement, or legal compliance.
2. Subscription, Billing & Cancellation
2.1. Subscription Plans
Subscription plans may vary by price, duration, and included features. Detailed descriptions are available via the App Store or Google Play. Promotions may be offered from time to time.
2.2. Billing Cycle
Your billing cycle will begin on the date you subscribe and will automatically renew unless canceled. You authorize us to charge your selected payment method each billing period unless the subscription is canceled in advance.
2.3. Cancellation Policy
You may cancel your subscription at any time via your App Store or Google Play account settings. Cancellations apply to the next billing cycle; no refunds are provided for partial usage.
2.4. Updating Payment Methods
It is your responsibility to maintain accurate and valid payment methods. Failure to update may result in suspension of service.
3. Privacy and Data Protection
3.1. Children’s Data
SKULI complies with applicable child data protection laws, including COPPA (Children’s Online Privacy Protection Act) and Québec/Canadian privacy regulations. We only collect personal data necessary for the operation of the service (e.g., profile name, gender, birth date, learning progress, app activity).
3.2. Parental Consent
By creating a profile for a child, you confirm that you are the legal guardian and consent to the use and storage of limited data necessary for educational progress tracking.
3.3. Data Storage and Security
All data is securely stored using Firebase and other trusted third-party infrastructure. While we implement industry-standard protections, no system is immune to breaches. You are responsible for safeguarding login credentials.
3.4. Data Access and Deletion
You can delete all your personal data by clicking the delete account link in the app settings page. Deleting a child’s profile will permanently erase their data and progress.
4. Account Access and Security
4.1. Parent Accounts and Control
Parents/guardians are responsible for all activity on their SKULI account. You must protect your password and parental access code, and ensure they are not shared with children or unauthorized persons.
4.2. Security Breach Notification
If you suspect unauthorized access to your account, contact us immediately. We reserve the right to suspend any account suspected of fraudulent or abusive activity.
4.3. Multiple Profiles
A single SKULI account may support multiple child profiles. Each profile is bound to the parent’s account and inherits the subscription plan status.
5. Acceptable Use and Conduct
5.1. Prohibited Activities
You agree not to:

Attempt to access or modify other users’ data

Use the app to upload malicious content, spam, or unauthorized scripts

Circumvent access restrictions or attempt reverse engineering

Exploit free usage by creating multiple fake accounts
5.2. User-Generated Content
Any content you submit (e.g., personalized notes or comments) remains your responsibility. We reserve the right to remove content that violates our policies or local law.
5.3. Suspension and Termination
We may suspend or terminate your access to SKULI in the event of breach of these Terms, suspected abuse, or required legal compliance.
6. Limitation of Liability
6.1. Service Availability
SKULI is provided “as is” and “as available”. We do not guarantee uninterrupted access, nor that the app will be error-free or meet your specific learning objectives. Occasional downtimes for updates or technical issues may occur.
6.2. Indirect Damages
To the fullest extent permitted by law, SIRBAA Inc. shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use or inability to use the SKULI app — including data loss, educational outcomes, or emotional distress.
6.3. Maximum Liability
In any case, our total liability shall be limited to the amount paid (if any) by the user in the 6 months preceding the claim.
7. Governing Law and Dispute Resolution
7.1. Applicable Law
These Terms of Use shall be governed by and interpreted in accordance with the laws of the Province of Québec and the laws of Canada applicable therein.
7.2. Jurisdiction
Any disputes or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Québec, Canada.

Requests, report abuse, or resolve account issues must be submitted from the email associated with your SKULI account.
9. Changes to These Terms
9.1. Revisions
We reserve the right to modify these Terms at any time. You will be notified via email or in-app messaging if significant changes are made. Continued use of the app after such changes constitutes your acceptance of the updated Terms.
10. App Store License
The SKULI app is made available through the App Store and Google Play and is licensed, not sold, to you.
Your use of the app is subject to:

Apple’s Licensed Application End User License Agreement (“Standard EULA”)

Google Play’s Developer Distribution Agreement
The license grants you a limited, non-exclusive, non-transferable right to use the app on devices you own or control, solely for personal, non-commercial use.
