1. ACCEPTANCE OF TERMS

By downloading, installing, or using the POISONED mobile application (the "App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.

 

2. MEDICAL & SAFETY DISCLAIMER

THE APP IS FOR INFORMATIONAL PURPOSES ONLY. DO NOT RELY ON THE APP FOR LIFE-SAFETY DECISIONS.

  • AI Limitations: The AI plant analysis is an estimation. Accuracy is not guaranteed and can be affected by lighting, camera quality, or botanical variations.

  • No Professional Advice: The App does not provide medical or toxicological advice. Always consult a professional or local poison control center.

  • Assumption of Risk: You assume all risks associated with the handling, ingestion, or proximity to toxic plants. Never eat any plant identified by this App.

3. LOCATION SERVICES & APPLE MAPS

  • Map Services: The community map is powered by Apple Maps. By using the map features, you also agree to Apple’s Maps Terms of Service.

  • Proximity Notifications: The App uses GPS to send alerts when you are near reported toxic plants. We do not guarantee the real-time accuracy of your GPS location or the precision of the plant's coordinates. Do not rely on alerts to ensure your safety.

4. USER-GENERATED CONTENT (MAP)

By contributing data, photos, or anonymous comments to the map, you:

  • Warranty: Represent that the information is accurate to the best of your knowledge.

  • License: Grant us a perpetual, worldwide, royalty-free license to use, display, and distribute this content.

  • Anonymity: Understand that while comments are displayed anonymously to others, we may retain metadata as required by law.

  • Prohibited Content: Agree not to upload misleading, offensive, or copyrighted material. We reserve the right to delete any user point at our discretion.

5. USER ACCOUNTS & HISTORY

  • You are responsible for maintaining the security of your device and your scan history.

  • We reserve the right to suspend accounts that provide habitually false data to the community map.

6. INTELLECTUAL PROPERTY

The App’s design, AI algorithms, logo, and branding are the exclusive property of [Your Company Name]. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial use.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law, [Your Company Name] and its developers shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to bodily injury, poisoning, or death, arising from your use of the App or reliance on its data.

8. TERMINATION

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the community.

9. GOVERNING LAW

These Terms shall be governed by the laws of Québec, CANADA, without regard to its conflict of law provisions.
